Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Heroes Tribute Wall ("we," "us" or "our"), concerning your access to and use of the heroes.815.media website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

User Representations

By using the Site, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete;
2. You will maintain the accuracy of such information and promptly update such registration information as necessary;
3. You have the legal capacity and you agree to comply with these Terms of Service;
4. You are not a minor in the jurisdiction in which you reside;
5. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise;
6. You will not use the Site for any illegal or unauthorized purpose;
7. Your use of the Site will not violate any applicable law or regulation.

User Registration

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Tributes and User Content

Our Site allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Site, including its legality, reliability, and appropriateness.

By posting Content on or through the Site, You represent and warrant that:

1. The Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms of Service;
2. The Content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity;
3. The Content does not contain any material that solicits personal information from anyone under the age of 18 or exploit people under the age of 18 in a sexual or violent manner;
4. The Content does not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
5. The Content does not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap;
6. The Content does not otherwise violate, or link to material that violates, any provision of these Terms of Service, or any applicable law or regulation.

Content Restrictions

The following types of Content are not permitted on the Heroes Tribute Wall:

• Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;
• Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national, or international law;
• Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party;
• Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
• Unsolicited promotions, political campaigning, advertising, or solicitations;
• Private information of any third party, including addresses, phone numbers, email addresses, and credit card numbers;
• Viruses, corrupted data, or other harmful, disruptive, or destructive files;
• Content that is unrelated to the topic of the tribute or memorial.

Content License

By posting Content on or through the Site, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of your Content. This license allows us to display your tributes on the Site and use them to promote our service.

Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Site, or contact us to request account deletion.

Governing Law

These Terms shall be governed by and defined following the laws of the United States and the State of Illinois. Heroes Tribute Wall and yourself irrevocably consent that the courts of Illinois shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will alert you about any changes by updating the "Last updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change.
